Terms of service

These terms govern your use of Kept, an operations platform for cleaning and housekeeping companies, including the website atfeelkept.com and the Kept mobile applications. By using Kept you agree to these terms. If you don't agree, don't use the service.
Who can use Kept
Kept is a workplace tool. You must be at least 18 and using Kept on behalf of a business (or as an authorized member of a business that subscribes to Kept). If you signed up on behalf of a housekeeping company, you confirm you have the authority to bind it.
Accounts and security
- You are responsible for activity under your account.
- Keep your password secret. Tell us promptly if you suspect unauthorized access.
- One person per account. Don't share credentials.
- We may suspend an account that's being used to attack the platform or other accounts.
Subscriptions and pilots
Kept offers tiered plans: Pilot (free during the early- access window), Starter, Pro, and Enterprise. Plan features are listed on the platform and may change. Pilot accounts can be converted to a paid tier at any time; if the pilot window expires without an upgrade, the account becomes read-only until the operator upgrades or the operator asks us to extend.
Payment processing
Operators on a paid tier collect from their own clients using their own connected Stripe account. Funds flow to the operator. Kept does not hold operator-customer payments. The operator is responsible for taxes on payments they collect, and for any disputes raised by their own clients.
Subscription fees from operators to Kept are billed separately and are non-refundable except as required by law.
Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of Kept beyond what the law allows;
- Scrape, crawl, or send automated traffic to the platform without our written permission;
- Upload malware, viruses, or other harmful code;
- Use Kept to send unsolicited marketing communications;
- Misuse another user's account or attempt to access data you're not authorized to see;
- Use Kept for any unlawful activity.
Your content
You retain ownership of the data and content you put into Kept (property records, photos, invoices, staff records, etc.). You grant Kept a worldwide, non-exclusive license to host, process, and display that content as needed to operate the service for you.
Third-party services
Kept integrates with third-party services: Airbnb, VRBO, Hostaway, Guesty, Stripe, Resend, Twilio, Dialpad, Mapbox, Firebase, Supabase, and others. Your use of those services through Kept is also subject to those providers' terms.
Service availability
We aim for high availability but do not guarantee uninterrupted service. Kept is provided "as is" without warranty of any kind to the maximum extent the law allows.
Limitation of liability
To the maximum extent the law allows, Kept's total liability for any claim arising out of these terms or your use of the service is limited to the fees you paid Kept in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost revenue, or lost data.
Indemnification
You agree to indemnify Kept against claims arising from your use of the service, your violation of these terms, or your violation of any third party's rights.
Termination
You may stop using Kept at any time. We may suspend or terminate access for breach of these terms or for any conduct that materially harms the platform or other users. On termination we will delete or anonymize your data per our privacy policy.
Changes
We may update these terms. The "Last updated" date at the top will reflect the change. Material changes are notified to operators by email. Continued use of the platform after the change takes effect means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Disputes are resolved in the state or federal courts located in Summit County, Colorado.
